A presentation by Barrister Amanda Gourlay at the Southwark Homeowner Council Spring Conference 2020

Bio;   Amanda specialises in residential and mixed-use leasehold matters, including service charges, disrepair, landlord and tenant-related insolvency and applications for the appointment of a manager. She has a particular interest in the recoverability of legal costs in court and in the tribunals. 

In 2017 she appeared twice in the Court of Appeal in service charge-related appeals, and in February 2018 represented a group of leaseholders at the Citiscape development in Croydon in the first case to reach the First-tier Tribunal on the recoverability of the costs of both a waking watch and replacing the cladding. 

January 2019 saw her give evidence to the Housing, Communities and Local Government Select Committee Inquiry into leasehold reform, and later that year, she was the leaseholders’ advocate in LB Southwark v Royce & Nicoue, a case where she successfully resisted the local authority’s appeal against the First-tier Tribunal’s decision that the leaseholders should not contribute towards the cost of replacing heating pipework on a different estate to their own.

Amanda is the author of Law and Lease, a blog about service charges (; a Fellow of the Institute of Residential Property Managers and speaks regularly (and enthusiastically) at events about service charges and associated issues.
